Enclosed please find the Rules and Regulations on Controlling Utility Cuts. Please note that I have numbered each document.
#1 is the Rules and Regulations to Control Street Cuts. Please note that through the Regulations we ask you to see Appendixes A, B, C, D, E, F, and G that should be attached to the regulations.
#2 is Appendix A, the specifications on the Shrinkless Fill.
#3 is Appendix B, the specifications for furnishing an all season dryer for the Shrinkless Fill.
#4 is Appendix C; it would be the concrete placement specifications in accordance to your present specifications on the placement of streets, sidewalks and approaches.
#5 is Appendix D; it would be the specifications of the asphaltic material to be used. In most areas it is the present specifications for asphalt wearing course installed full depth.
#6 is Appendix E, specifications on equipment to be used in the thermal weld asphalt repair process.
# 7 is Appendix F, specifications on filling in a low area on asphalt pavement.
#8 is Appendix G; it would be the traffic control. Again, most likely your present specifications will work.
I hope that this gives you some help in setting up a utility cut program. This is the “state of the art” that will not be exceeded for years to come and can only be a great asset toward your total street maintenance program.

RULES AND REGULATIONS
TO CONTROL STREET CUTS
Section #1 Permits No person or other governmental agencies shall make any excavation or opening in or under any street, alley or public place without first obtaining a written permit from the governing agency. The fee for such permit shall be in accordance with the attached fee schedule.
Section #2 Emergency Street Cuts The governing agency may, if the public safety required immediate action, grant permission to make a necessary street cut or excavation before a permit is issued.
Section #3 Inspection In all cases the permit applicant for a street cut shall notify the governing agency when the work will commence so, if necessary, arrangements may be made to have an inspector present while the work is in progress. The applicant may be billed for the necessary expense of the inspector.
Section #4 Rigid Pavement Replacement Concrete on earth
1. Saw Cuts All pavement cuts shall
be saw cut in a straight and rue manner and shall be made at right angles
or parallel to the pavement center line. Cuts shall be made to a
depth of five inches.
2. Backfill All trenches, holes, and pits shall be filled with Thermal Power Shrinkless Fill or equal, *compacted to not less than 95% of the maximum unit weight and all backfill compaction will be subject to check by the governing agency. Immediately following the placement of the Thermal Power Shrinkless Fill, the top portion shall be dried out to a minimum depth of eight inches. This shall be accomplished by an all season dryer for Shrinkless Fill manufactured by the Thermal Power Corporation or equal. ** Restoration shall be such that it could provide a condition equal to or better than the original condition.
All care is to be taken to insure that undermining of the adjacent pavement does not occur. Where necessary, bracing, shoring, and/or sheeting shall be used to support the sides of the excavation and to prevent any movement that could damage any other services, adjacent pavements, etc. This excavation support system shall be removed as back-filling proceeds. Unsuitable soil at the bottom of the utility cut shall be removed prior to bedding and service installation. Appropriate restoration of all services encountered is the responsibility of the applicant. All excavated material shall be removed from the site. The utility cut shall be kept free of water at all times.

3. Concrete Pavement Replacement The work of final concrete restoration shall be performed by the permittee according to the governing agency. ***
Section # 5 Flexible Pavement
Replacement Over an aggregate, concrete, or brick base.
1. All pavement cuts shall be made with an asphalt spade or equivalent in a straight and true manner and shall be made at right angles or parallel with the centerline of pavement.
2. Backfill The backfill procedure for these pavements shall be the same as the specifications for Rigid Pavement with the exception that the fill material should be brought up to the bottom of the pavement or a minimum of four inches from the surface, whichever is greater.
3. After the backfill has been accomplished, the vertical edges of the existing pavement shall be cleaned and an asphalt bond coat applied to the existing concrete or brick and asphalt pavements.
4. Asphalt shall be placed the full thickness of the concrete or brick and continuing up to 1 _ inches from the top of the asphalt pavement compacting every four inches. ****
5. Then the asphalt pavement surrounding the cut shall be heated until it is soft enough to scarify a minimum of three inches beyond the edge.
6. Finish filling the cut with asphalt, compact and weld the new asphalt with the surrounding scarified asphalt.
7. This procedure must be accomplished by qualified personnel trained by the manufacturer of equipment to be used, and must have a minimum of five years experience in this method. The equipment used must be an approved all season asphalt maintainer such as the Patch Master manufactured by O’B Inc. or equal. *****
Section #6 Sidewalk, Driveways and
1. Replacement Whenever a part of a block, square or section of curb, sidewalk or driveway is broken or damaged by the person making any excavation or opening in or under any street, alley or public place, the entire block, square or section shall be removed to the score, groove or saw cut line and replaced or reconstructed. Where the line of cut would be less than two feet from an existing expansion or weakened place joint, the concrete shall be removed to said joint.

Section #7 Markings Each Street
Cut shall be marked with a four-inch diameter circle in accordance with
the following color code:
Electric Utility Safety Red
Gas Utility High visibility safety yellow
Telephone Utility Safety alert orange
Water Utility Safety precaution blue
Sewer System Safety brown
Section #8 Trenching Operation At no time shall more than 200 feet of trench be opened and incompletely backfilled. The remainder of the area of trenching operation shall be available for safe vehicular and pedestrian traffic at all times. Special exceptions may be allowed by the governing agent.
Section #9 Restoring Flexible Pavement Adjacent to Cuts If the paving surface adjacent to the street openings is damaged or where the equipment used may cause such damage, it will require the permittee to restore it to its original condition by means of reheating, scarifying, re-leveling the existing surface, and the addition of any new asphalt that may be required. This restoration shall also be accomplished by an approved all season asphalt maintainer such as the Patch Master manufactured by O’B Inc. or equal. (refer to Appendix E and F)
Section #10 Any operation in the right-of way not covered by the above specifications, submitted with this permit, shall be done in accordance with the instruction of the governing agency.
Section #11 In granting any permit,
the governing agency may attach such other conditions thereto as may be
reasonably necessary to prevent damage to public of private property or
to prevent the operation from being conducted in a manner hazardous to
life or property or in a manner likely to create a nuisance. Such
conditions may include but shall not be limited to:
(1) limitations on the period of the year in which the work may be performed; (2) restrictions as to the size and type of equipment commensurate with the work to be done; (3) designation of routes upon which materials may be transported; (4) the place and manner of disposal of excavated materials; (5) requirements as to the laying of dust, the cleaning of streets, the prevention of noise, and other results offensive or injurious to the neighborhood, the general public, or any portion thereof; and (6) regulations as to the use of streets in the course of the work.
Section #12 The permittee shall notify the governing agency in writing upon completion of all work accomplished under the provisions of the permit. A certificate of final inspection shall be issued by the governing agency to each permittee three years after the permanent restoration of the excavation has been performed according to the governing agency specifications. Prior to the issuance of a certificate, the governing agency shall make a final inspection of the restoration to determine whether the governing agency specifications have been adhered to.
Section #13 If any settlement or cracking in a restored area occurs within a period of three years from date of completion of the permanent restoration, the governing agency will notify the permittee. Restoration must be made and notice sent back to the governing agency that corrections were made within 48 hours. Repairs that suggest an emergency condition shall be checked in the field immediately and such action shall be taken to remedy the condition. If the restoration is not completed within 48 hours or as necessary in an emergency situation, the governing agency may make the correction and any expense incurred by the governing agency shall be paid by the permittee or recovered from his bond unless the permittee submits proof satisfactory that the problem that occurred was no fault of his workmanship.
Section #14 Repairing Restored Areas
in Flexible Pavement
1. Settlement Clean the area of all loose and foreign materials. Heat the settled area so that minimum of _ inch can be scarified. Add the necessary new asphalt wearing course welding it to the existing asphalt. (see Appendix E for approved equipment). Compact with an approved compactor or roller. Application of a tack coat and the installing of a skin patch will not be accepted. The repair shall be made with an approved all season asphalt maintainer such as the Patch Master manufactured by O’B Inc. or equal and in accordance to the specifications for such repairs. ****** (refer to Appendix E for equipment Specifications).
2. Cracks Cracks shall be cleaned of all loose and foreign material then filled with a hot rubber crack sealer or equivalent.
Section #15 Repairing Restored Areas in
1. Settlement Clean the area of all loose and foreign material and prepair the surface for an acceptable concrete filler.
2. Cracks Cracks shall be cleaned of all loose and foreign material, then filled with a hot rubber crack sealer or equivalent.

Section # 16 In no case shall any opening made by a permittee be considered in the charge or care of the governing agency, or any of its officers or employees, and no officer or employee is authorized in any way to take or assume any jurisdiction over any such opening, except in the exercise of the policy power, when it is necessary to protect life and property.
Section #17 Permanent Trench Repair The permanent repair shall be completed immediately following the compacted and approved base. The traffic control that was set up for the initial cut shall remain in place for this operation. These cuts are to be repaired in this manner twelve months of the year.
Section # 18 Temporary Trench Covering The City will not allow any cuts in the streets to be covered with temporary material unless it is under extreme weather conditions or because of other emergencies declared by the governing agency.
Section # 19 Traffic Control for
street construction and maintenance operation shall be in strict accordance
to the specifications of the governing agency. *******

*APENDIX A ? SHRINKLESS FILL
The work included in this specification is the supply of all material, labor and equipment necessary for the production and placing of a Portland cement stabilized granular backfill known as Unshrinkable Fill in all underground service and utility trenches, and around in-ground structures.

Mix operations shall be selected in accordance with the latest standard practices in the industry for such products.
The contractor shall provide to the engineer, upon request, proof that the fill material being used has been approved by O’B Inc. or Pavement Savers, Inc.
The unshrinkable fill material shall be placed in such a manner that it shall flow into the excavation so that it fills the entire space. Care shall be taken to insure that no air is trapped beneath horizontal projections or in other locations within the excavation.
Where bracing, shoring, and/or sheeting is used to support the sides of the excavation or to prevent movements that could damage other services or adjacent pavements, this support system shall be removed as backfilling proceeds.
** APENDIX B
SPECIFICATIONS FOR FURNISHING AN ALL SEASON DRYER FOR THERMAL POWER SHRINKLESS FILL
The following are minimum specifications considered necessary to perform the work assigned and must be the product of a manufacturer actively engaged in the production of asphalt Heater-maintaining equipment for a period of not less than five years and to embody their latest improvements in design and construction.
Heating Panel must be of Thermal Power “Luminous Wall” construction or equal. A source of completely controlled 100% radiant, free of any flame of more than two inches. It also must offer the following advantages:
A. With controllability so as to dry out
the top layer of the Thermal Power Shrinkless Fill to a minimum depth of
eight inches in 15 minutes under normal weather conditions; being a temperature
of not less than 50 degrees F, light wind, no precipitation. It shall
be capable of heating to the same depth in 20 minutes in extreme weather
conditions; a temperature of less than 40 degrees to 0 degrees, winds over
20 M.P.H. and precipitation to the point of running water.
B. The heating system shall be 100% radiant, no flame, and have the capability to evenly adjust the output from 30,000 to 60,000 B.T.U.’s in each square foot of the chamber surface to allow the machine to be pre-adjusted for the various asphalt types and environmental conditions. The heating unit must be quickly and easily controlled ? instant “ON ? OFF”, so firing time can be adjusted to correspond to the environmental condition, the composition of the asphalt being worked on and other variables. The heat supplied must correspond to the needs with the highest possible heating rate, with an instant cool down rate such that the actual heating surface can be touched after it is off for two minutes.
C. The minimum size requirement of the heating panel is 6’ x 6’ and shall be made to be converted to 3’ x 12’, also it shall be divided into four electrically controlled zones.
D. Each zone must be individually controllable in any combination of “OFF” and “ON” sequence and be equipped with pilot lights.

SPECIFICATIONS FOR FURNISHING AN ALL-SEASON HEATER ASPHALT MAINTAINER.
The following are minimum specifications considered necessary to perform the work assigned and must be the product of a manufacturer actively engaged in the production of asphalt Heater-Maintaining equipment for a period of not less than five years and to embody their latest improvements in design and construction.
This unit must have a heating panel of a Thermal Power “Luminous Wall” construction or equal, a heated insulated asphalt hopper and a means to deliver the asphalt from the hopper to the area to be repaired.
Heating Panel must be of Thermal Power “Luminous Wall” construction or equal. A source of completely controlled 100% radiant, free of any flame of more than two inches and must offer the following advantages:
With controllability so as to soften existing or surrounding asphaltic surface materials, capable of heating to a suitable temperature for scarifying the asphalt a minimum depth of _” in three minutes under normal weather condition; being a temperature of not less than 50 degrees F., light wind, no precipitation. It shall be capable of heating to the same depth in five minutes in extreme weather conditions; a temperature of less than 40 degrees to 0 degrees F, winds over 20 m.p.h. and precipitation to the point of running water.

The heated storage compartment must be capable of (A) maintaining working temperature new permanent type asphalt that has been properly stockpiled; (B) reheating new permanent type asphalt that has been properly stockpiled; (C) reheating a good quality reclaimed asphalt that has been properly stockpiled.
There shall be an insulated auger extension in two sections to deliver the asphalt material over the heating panel and into the repair area. The insulated extension auger must fold up for transport and tilt up and down with the power tilting of the heating panel. The section of the auger shall be easily separated to compensate for the changes in the heating panel.
COMPACTION EQUIPMENT must be a combination of Vibra plate and Vibratory roller. The Vibra plate shall be used when placing asphalt in lifts and the Vibratory roller shall be used for the final application. Both units shall be equipped with a water system and have a minimum centrifugal force of 2,000 lbs.
All other asphalt equipment to be used
shall be in accordance to the standard practices in the industry for the
area in which the work is to be performed.
SPECIFICATIONS FOR FILLING A LOW AREA IN ASPHALT PAVEMENT
1. Clear the area of all loose and foreign
2. Lower the Patch Master heating unit parallel with the pavement. Heat and scarify the area to be filled.
3. Apply a rejuvenator (Reclamite of equal) to the existing asphalt at the rate of 1/10 gallon per square yard.
4. Place the new asphalt material by hydraulically auguring it from the Patch Master’s heated storage compartment, molding it to the existing asphalt.
5. Compact with an approved compactor or roller.
